General Terms and Conditions for N-tours Inc.

N-tours Inc. referred to hereafter by "Ntours" “us”, “we”, or “our” operates the Ntours website and conducts the operations of tours/experiences (the “Service”).

These terms and conditions may change from time to time. Ntours will update this page when this happens. You need to check this page from time to time to ensure that you are aware of the latest changes and updates.


Tours/experiences

As we continue to strive to improve our products and services, tours/experiences may differ slightly to those featured in any publication including but not limited to brochures, flyers and on this website. In the case of inability of conducting a tour/experience or providing a product, service or activity detailed in an itinerary promoted by us, an alternative will be offered within our possibility. Itineraries may vary and/or attractions be substituted for any cause, which include but not limited to seasonal conditions, weather extremes, natural disasters, and local governmental rules and regulations.


Prices

Prices published on this website could be re-evaluated and altered at any time without affecting any previous sales. In the case of any such change or the availability of any of our tours/experiences at a reduced price through any of our vendors, Ntours will not reimburse customers with the difference or make any refund to purchases made and consumed in the past or within 24 hours from the tour/experience.


Errors in pricing

If the amount you pay for a tour/experience is incorrect regardless of whether it is because of an error in a price posted on this website or otherwise communicated to you, then: we will ask you to pay the difference, and if you do not agree to pay the difference, Ntours have the right to cancel your transaction and issue a refund with the amount that you paid. This will apply regardless of whether because of human error or a transactional malfunction of this website or any other Ntours affiliate operated system.


Cancellation, rescheduling and refunds

Unless an exception is clearly mentioned, in order to get a full refund or be able to reschedule your tour, it needs to be done at least 24 hours in advance. Rescheduling within less than 24 hours is subject to Ntours approval. In case of customer cancellation within 24 hours, there will be no-refund. Refunds will not be issued for No Shows.


Tour/experience cancellation

Ntours reserves the right to cancel any tour/experience or any activity on the agreed date without a period of notice, if weather conditions, official measures, strikes, demonstrations or other unavoidable external conditions may have a direct effect on the safety of our guests or make the execution of the tour/experience or activity considerably more difficult or endanger it. In the event that a tour/experience is canceled by Ntours, we may propose to postpone or reschedule the tour/experience or propose another tour/experience instead, and if a customer refuses to accept our proposal, a full refund will be issued to the credit card used to purchase the tour/experience. Please note that this can take up to several days and it is subject to banks operations and policies.


Group travel

Terms and conditions here do not apply to group private bookings, which will be subject to separate terms and conditions stated at the time of confirmation by Ntours and may vary depending on group size and date of booking and travel.


Pick up and drop off

Ntours offers its customers an optional complimentary pick up and drop off from certain locations in downtown Montreal if they don't want to join the tour at the specific starting point. Pick up and drop off times are subject to change at short notice due to external factors that may include but not limited to last minute bookings, weather conditions, road works or closures, traffic, accidents and mechanical breakdown. Failing to provide a pick up and/or drop off for any logistical or circumstantial reason will not incur any responsibility on Ntours and neither reimbursement nor refund will be issued. In such events, customers will be notified via there provided email address and/or mobile number, and it will remain the customer responsibility to join the tour from the specific starting point. Failing to do so would be considered a No Show and no refund will be issued.


Weather

Tours and Events operate in all types of weather. Refunds will not be given for weather conditions.


Insurance

The price of the services does not include insurance. You are responsible for providing your own insurance protection.


Joining the tour/experience and compliance with conditions

You are responsible for arriving on time at the agreed pick up location or at the notified meeting point. You are responsible for having the necessary tickets/vouchers and self-identification documents (I.D, passport etc.), and for observing the applicable health regulations etc. In the event of you missing the tour/experience because of not observing any of that, Ntours will not issue any refund.


Ejection and cancellation

By participating in our tours/experiences, you agree to accept the authority of the Tour-Guide and accept their decisions.

Any threats to safety, being physical or verbal, or inappropriate behaviour may result in removal from the tour/experience. Ntours reserves the right, without issuing a refund of any paid amount, to refuse to carry a guest who fails to comply with Ntours rules, or eject, any person whose conduct management deems disorderly or is detrimental to the enjoyment of the group, or to the entitlement to a safe environment for our guests and staff. Breach of terms or rules will terminate your ability to attend the tour/experience without refund, and if a Tour-Guide requires a guest to leave the tour, no refunds will be given and that guest will be responsible for their own travel costs and arrangements from that point.


Photography, Video-Recording

You agree that the tour/experience you purchase is a public event, that your appearance and actions inside and outside the vehicles where the tour is conducted are public in nature, and that you have no expectation of privacy with regard to your actions or conduct during the tour/experience.


You agree that, while participating in any tour/experience, images, photos or videos may be taken by other participants or Ntours staff that may feature you.


You consent to grant a perpetual, royalty-free, worldwide, irrevocable license to Ntours, its contractors, sub-contractors and assigns and any third party involved in the tour/experience to utilize your name, image, likeness, poses, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the tour/experience (regardless of whether during or after the tour/experience) for any purpose (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to, you or anyone acting on your behalf.


Vehicles may be equipped with dashcam technology that records high-definition sound and video. Footage recorded during the tours may be used for promotion, legal, insurance and training purposes and may be used to verify performance related questions, queries or concerns.


Providing contact information

During the booking process, you will be required to provide a valid email address and mobile number that are functional and accessible by you in the tour/experience location. Ntours staff use that contact information to provide you with information, communicate changes regarding your booking, or to identify you at the agreed tour/experience joining point. It is your responsibility to make sure that the provided contact information is correct and accessible to you at all times. Failing to join a tour/experience because of not being able to access your email, voice and/or text messages or inability to receive phone calls/ use your mobile phone remains your fall responsibility, and in the event that this leads to missing your tour/experience, Ntours will consider this as a No Show and no refund will be issued.  


Consent to receive Emails

By placing my order with Ntours I am providing my irrevocable consent to receive emails regarding my tour(s)/experience(s) from or on behalf of Ntours. I also agree to receive any other proposals or suggestions from Ntours in regards to their other tours/experiences.


Consent to receive text messages and telephone calls

By placing my order with Ntours and providing a mobile number, I am providing my irrevocable consent to receive text messages and/or telephone calls regarding my tour(s)/experiences(s) from or on behalf of Ntours. I understand that this consent applies only to text messages and/or telephone calls related to tour(s)/experience(s) that I have booked with Ntours.


Applicable Law

These Terms and Conditions of Use shall be governed by, and construed in accordance with the laws of the Province of Quebec, Canada. Any dispute arising from these terms shall be resolved exclusively in the provincial and federal courts in Montreal, Quebec, Canada.
